The Unified Patent Court is now live

The Unified Patent Court is now live as the sunrise period has ended.

As we have previously reported, the Unified Patent Court (UPC) is now live as the sunrise period has ended. This means that proceedings may be commenced before the UPC. However, any patent owners who wish to opt their patents or applications out of the UPC may still do so as long as there are no proceedings underway against the patent.

Several of us here at Wilson Gunn are now registered as representatives before the court, and we have already filed hundreds of opt outs.

We have also deliberately not opted out certain cases and have received a number of instructions for validation of certain patents as a Unitary Patent. We are happy to advise on validation strategies and what would be best for your business.

Additionally, we can now file applications for central revocation of any patents which have not been opted out of the UPC.
